Terms of service
These Terms of Use (hereinafter, the "Terms") govern access to and use of the Tuscany Market Hub marketplace, accessible at tuscanymarkethub.it (hereinafter, the "Marketplace"). These Terms regulate browsing and use of the Marketplace; the conditions governing the purchase of goods offered on the Marketplace are contained in the Conditions of Sale. The procedures for exercising the right of withdrawal are set out on the Right of Withdrawal page.
Access to the Marketplace and the use of the contents and functionalities available therein imply reading and acceptance of these Terms. Users who do not intend to accept them are requested not to use the Marketplace.
1. Identification of the Marketplace owner
The Marketplace is managed by:
Federazione Italiana Ambulanti (FIA) — implementing body of the Tuscany Market Hub project. Regional application code: 369.20250414.998000091.
The full identification data of the owner (company name, registered office, VAT number, tax code, REA number, certified email address, contact details and registrations in registers or professional bodies) are published on the Contact Us page.
This information is provided pursuant to Article 7 of Legislative Decree 9 April 2003, no. 70, concerning electronic commerce and information society services.
2. Nature of the Marketplace and operating model
The Marketplace is a digital platform that connects artisanal and agri-food producers from the Tuscan territory (hereinafter, the "Producers") with end customers (hereinafter, the "Users" or the "Buyers"), allowing the latter to purchase products offered by the Producers.
The contractual relationship of sale and purchase concerning products purchased through the Marketplace is established directly between the Producer and the Buyer. The Marketplace owner acts as the platform manager and performs technical intermediation, purchase process management, logistical coordination, and customer care functions, as specified in the Conditions of Sale.
The Marketplace owner is not a seller of the products offered on the Marketplace, except in cases where this is expressly indicated. The owner is not a producer, importer, distributor, or processor of the goods offered.
3. Access and Use Modalities
Access to the Marketplace is free. To use the purchase functionalities, the User can proceed alternatively:
- As a guest, providing only the data strictly necessary for the completion of the current order (so-called "guest checkout");
- Through a registered user account, which allows personalized management of the shopping experience, consultation of order history, and storage of delivery data.
Use of the Marketplace is reserved for adults (aged 18 or over) who have the capacity to enter into binding contracts under Italian law.
4. User Account
4.1 Registration
User account registration occurs through the completion of the dedicated form and email address confirmation. Registration is free. The User guarantees the truthfulness, accuracy, and completeness of the data provided during registration and undertakes to keep them updated.
4.2 Credentials and security
The User is obliged to diligently safeguard their access credentials (email address and password), not to disclose them to third parties, and to adopt appropriate IT security measures (use of strong passwords, not reusing the same password on multiple services, eventual two-factor authentication where available). The User is responsible for all activities carried out through their account.
In case of suspected unauthorized use of the account, the User is obliged to promptly notify the owner through the indicated contact channels.
4.3 Account Cancellation
The User can request the cancellation of their account at any time through the dedicated function available in the personal area of the Marketplace, or by writing to the owner at the contact details published on the Contact Us page. Account cancellation does not entail the cancellation of data related to orders already placed and to accounting and tax documents, which will be retained for the period prescribed by applicable law, as illustrated in the Privacy policy.
4.4 Suspension and Deactivation
The owner reserves the right to suspend or deactivate the User's account, after prior notification, in case of:
- violation of these Terms or the Conditions of Sale;
- fraudulent, abusive, or harmful conduct towards the Marketplace, Producers, or other Users;
- use of the Marketplace in violation of applicable law;
- prolonged account inactivity beyond any communicated deadlines.
5. User Code of Conduct
The User undertakes to access the Marketplace and use its functionalities in compliance with applicable laws, principles of good faith and fairness, and these Terms. In particular, the User undertakes not to:
- use the Marketplace for unlawful purposes or in a way that causes harm to the owner, Producers, other Users, or third parties;
- interfere with the proper functioning of the Marketplace, by introducing malicious code, unauthorized access, system overload, or similar techniques;
- reproduce, copy, modify, distribute, or commercially exploit the contents of the Marketplace without authorization, except as provided in the following Article 6;
- extract data from the Marketplace using automated techniques (scraping, crawling, third-party indexing robots) for commercial purposes or in violation of the rights of the owner and Producers;
- enter false, incomplete, or third-party data without their authorization, especially during registration or checkout;
- place orders in bad faith or for purposes other than the actual purchase of the goods offered.
6. Intellectual Property
All contents of the Marketplace — including, but not limited to, texts, images, photographs, illustrations, graphics, videos, audio files, software code, trademarks, logos, domain names, and distinctive elements — are protected by intellectual and industrial property laws, including Law 22 April 1941, no. 633 (copyright law) and Legislative Decree 10 February 2005, no. 30 (Code of Industrial Property).
The ownership of the contents can be divided as follows:
- Institutional and project contents: belong to the Marketplace owner, unless otherwise indicated;
- Contents related to individual Producers (texts, photographs, descriptions, trademarks, product names): remain the property of their respective Producers, who authorize their use within the Marketplace solely for the purposes of selling and promoting their products;
- Third-party contents eventually integrated into the Marketplace (e.g., videos, maps, web fonts, graphic elements): are used in compliance with the respective licenses and remain the property of their respective owners.
Reproduction, in whole or in part, of the Marketplace contents is prohibited, except within the limits of legitimate personal and non-commercial use, without prejudice to the obligation to cite the source. Any other use is subject to the written authorization of the owner and, where applicable, of the interested Producers.
The trademarks "Tuscany Market Hub" and the distinctive elements of the brand are used within the Marketplace according to the provisions of the project and in compliance with the agreements between the involved parties.
7. User-Generated Content
The Marketplace may, where applicable, include functionalities that allow Users to publish content (e.g., reviews, ratings, comments). In such a case, the User guarantees to hold all necessary rights for publication and undertakes not to publish illicit, defamatory, deceptive, discriminatory content, content infringing on third-party rights, or content violating applicable law.
By publishing content on the Marketplace, the User grants the owner a non-exclusive, royalty-free, worldwide license for the maximum duration permitted by law, for the use of the published content within the Marketplace and for promotional purposes of the project, without prejudice to the author's moral rights.
The owner reserves the right to remove, even without prior notice, content deemed to violate these Terms or applicable law, and to suspend or deactivate accounts responsible for such violations.
8. Product Sheets and Producer Responsibility
The product sheets published on the Marketplace are prepared based on the information provided by the respective Producers. Producers are responsible for the accuracy, truthfulness, and completeness of the information related to their products, with particular regard to denomination, ingredients, allergens, labeling, compliance with safety standards, guarantees, and any other informative element required by applicable regulations.
The Marketplace owner adopts reasonable verification and editorial control measures, but does not guarantee the perfect correspondence of the product sheets to the actual state of affairs at all times. Users who find inaccuracies or discrepancies are invited to report them through the indicated contact channels.
9. Availability of Products and Services
The availability of products offered on the Marketplace is subject to variations depending on seasonality, Producer stocks, weather conditions, and other factors not always foreseeable. The owner and the Producers commit to keeping availability information updated, while acknowledging the possibility that, in exceptional cases, a product may be unavailable during order fulfillment. In such an event, the provisions of the Conditions of Sale apply.
10. Links to Third-Party Sites
The Marketplace may contain hyperlinks (links) to third-party websites. The presence of such links does not imply any approval, control, or responsibility of the Marketplace owner over the contents, services, or commercial practices of third-party sites. Users who access third-party sites via links on the Marketplace are invited to review the relevant information and terms.
11. Limitation of Liability
The owner adopts all reasonable technical and organizational measures to ensure the availability, integrity, and proper functioning of the Marketplace. However, it cannot be held liable for:
- interruptions, suspensions, or malfunctions of the Marketplace due to scheduled maintenance, technical events, cyber attacks, force majeure, or causes not attributable to the owner;
- direct or indirect damages resulting from accessing or using the Marketplace, except in cases of willful misconduct or gross negligence;
- content published on third-party sites accessible via links on the Marketplace;
- User conduct in violation of these Terms, the Conditions of Sale, or applicable law;
- the quality, safety, conformity, and legality of products offered by Producers, without prejudice to the User's rights as a consumer under applicable mandatory law.
This clause does not prejudice the rights recognized to the User as a consumer by applicable mandatory law, nor the responsibilities of the owner within the limits provided by law.
12. Personal Data Processing
The methods of processing personal data collected through the Marketplace are described in the Privacy policy and the Cookie policy, which constitute integral parts of these Terms.
13. Changes to the Terms
The owner reserves the right to modify these Terms at any time, including as a result of regulatory, organizational, or technological developments. The modifications are effective from the date of publication of the updated version of the Terms on the Marketplace. Substantial modifications may also be communicated to registered Users via email. The User is invited to periodically consult the Terms and Conditions page to check for any updates. The last update date is indicated at the bottom of the Terms.
14. Applicable Law, Competent Court, and Dispute Resolution
These Terms are governed by Italian law. For any dispute relating to the interpretation, execution, or validity of these Terms, the court of the User's place of residence or elected domicile shall have exclusive jurisdiction, if the User qualifies as a consumer pursuant to Legislative Decree 6 September 2005, no. 206 (Consumer Code). Otherwise, the court indicated by applicable law shall have exclusive jurisdiction.
Users are informed that the European Online Dispute Resolution platform ("ODR"), established by Regulation (EU) No 524/2013, was discontinued on 20 July 2025 following the repeal of that Regulation by Regulation (EU) 2024/3228. Users who qualify as consumers retain the right to use the alternative dispute resolution (ADR) procedures provided for by Articles 141 et seq. of the Italian Consumer Code, by applying to an ADR body listed by the competent authorities. For cross-border disputes involving traders established in other European Union countries, users may contact the European Consumer Centre Italy (ECC-Net Italy).
